1.About these terms

These terms govern your use of the RenterCheck website, property-checking tools, reports and related services at rentercheck.co.uk.

Please read them before using RenterCheck.

RenterCheck is operated by Digital Ideation Ltd, a company registered in England and Wales under company number 17059030, with its registered office at 128 City Road, London, EC1V 2NX.

In these terms, “RenterCheck”, “we”, “us” and “our” refer to Digital Ideation Ltd.

2.What RenterCheck does

RenterCheck is an independent property-information service intended to help people investigate properties they are considering renting in England.

Depending on the check or tool you use, RenterCheck may bring together information from public, official and other independent data sources and present it in a more accessible form.

This may include information relating to matters such as:

  • energy performance;
  • property characteristics;
  • recorded property sales;
  • planning and location-based designations;
  • proposed rent;
  • property licensing;
  • landlords or letting agents;
  • deposits and upfront payments; and
  • tenancy agreements.

Not every check is available for every property and not every feature described above is necessarily available in the free version of RenterCheck.

We will normally identify where a check could not be completed rather than treating the absence of data as a positive result.

3.RenterCheck is an information service

RenterCheck is intended to help you make more informed enquiries before renting a property.

It does not replace your own checks or professional advice.

Information provided by RenterCheck is not legal, financial, surveying, valuation or other professional advice.

A RenterCheck report is not a guarantee that:

  • a property is safe or suitable;
  • a landlord or letting agent is legitimate;
  • a proposed tenancy is lawful;
  • information supplied by a landlord or agent is accurate;
  • a tenancy agreement contains no problematic terms;
  • a property requires or does not require a particular licence;
  • a property is free from flooding, planning, title, structural or other risks; or
  • proceeding with a tenancy will be risk-free.

You should independently verify information that is important to your decision and seek appropriate professional or legal advice where necessary.

4.Third-party and public data

RenterCheck uses information obtained from third-party and public-sector datasets.

These may include information published by organisations such as HM Land Registry, the UK Government, local and national planning-data providers, Companies House and the Energy Performance of Buildings service.

Although we take reasonable care when obtaining, matching and presenting information, we do not control these underlying datasets.

Information may occasionally be:

  • incorrect;
  • incomplete;
  • unavailable;
  • recorded against a different property;
  • out of date;
  • delayed in being updated; or
  • inconsistent between different sources.

The date on which we retrieve information may therefore differ from the date on which an underlying event occurred or was recorded.

Where practical, RenterCheck identifies the source and limitations of information within the report.

5.“No result” and similar findings

The absence of information in a dataset does not necessarily mean that the underlying issue does not exist.

For example, wording such as:

“No designation identified in the checked dataset”

means that RenterCheck did not identify that designation in the data checked. It does not amount to an absolute guarantee that no such designation or issue exists.

Similarly, if a check is marked as unavailable, this should not be interpreted as a positive or negative finding.

6.Property matching

RenterCheck may use addresses, postcodes, Unique Property Reference Numbers and other property information to match records from different sources.

Property records are not always standardised consistently between datasets.

We take reasonable steps to identify the correct property, but you should check that the property shown in your report is the property you intended to search.

If you believe RenterCheck has matched the wrong property, please do not rely on the report and contact us.

7.Rental information

Any rental comparison, estimate or market information provided by RenterCheck is intended to assist comparison only.

Rental values can be affected by factors that may not be represented in the data available to us, including condition, furnishings, precise location, facilities, tenancy terms, supply and demand and individual negotiations.

Rental information should therefore not be treated as a formal valuation or a guarantee of the rent at which a property can or should be let.

8.Landlord and letting-agent checks

Where RenterCheck provides information about a landlord, company or letting agent, the information is based on the records and identifiers available to us.

A successful identity or company match does not guarantee that the person communicating with you is genuinely that person or is authorised to act for them.

Similarly, an inconsistency does not necessarily mean that fraud has occurred.

You should independently verify the identity of anyone requesting money from you before making a payment.

9.Tenancy agreement analysis

Where tenancy agreement analysis becomes available, RenterCheck may analyse a document that you choose to provide.

The purpose of this analysis is to identify and explain terms that may be useful for you to understand or question.

Automated analysis can make mistakes and may not identify every relevant provision.

Tenancy agreement analysis is not legal advice and does not determine whether a term is legally enforceable.

If a provision is particularly important, unusual, disputed or potentially unlawful, you should consider obtaining independent legal or housing advice.

10.Handling uploaded tenancy agreements

Where RenterCheck allows you to upload a tenancy agreement, our intended design is to process the agreement for the purpose of producing your analysis without retaining the original agreement as part of your RenterCheck report.

The original uploaded document and raw extracted text are not intended to be retained by RenterCheck after the analysis has been completed, subject to temporary technical processing necessary to provide the service.

The findings generated from the analysis may be retained as part of your report.

11.Free services

Some RenterCheck services are provided free of charge.

We may change, add or remove free tools or alter the information included in a free property check.

We do not guarantee that every dataset or check will always be available.

12.Complete RenterCheck

RenterCheck may display information about a planned or available paid service called Complete RenterCheck.

Where the website clearly states after you express interest that the service is not yet available for purchase, no contract for that paid service has been formed and no payment will be taken.

If you provide an email address to request early access, we will use it as described in our Privacy Notice.

When we begin accepting payment for Complete RenterCheck, the website will clearly display the price and the service being purchased before you place an order.

Additional terms relating to payment, cancellation, performance of the service and refunds will be provided as necessary before paid services are launched.

Nothing in these terms affects your statutory consumer rights.

13.Your responsibilities

You agree not to:

  • use RenterCheck unlawfully;
  • attempt to gain unauthorised access to our systems;
  • deliberately interfere with the operation or security of the service;
  • use automated systems to extract or scrape substantial amounts of information without our permission;
  • circumvent technical restrictions or rate limits;
  • reproduce or commercially resell RenterCheck reports without permission; or
  • submit documents or information that you are not entitled to provide or process.

You are responsible for checking that information you enter into RenterCheck is accurate.

14.Availability

We aim to keep RenterCheck available and functioning correctly, but we cannot guarantee uninterrupted availability.

The service depends partly on third-party infrastructure, APIs and datasets that may occasionally be unavailable.

We may temporarily restrict access where reasonably necessary for maintenance, security, abuse prevention or technical reasons.

15.Intellectual property

The RenterCheck website, branding, software, report design, original written content and other materials created by us are owned by or licensed to Digital Ideation Ltd.

Third-party and public-sector data remains subject to the rights and licences applicable to that data.

You may use a RenterCheck report for your own personal purposes.

You must not reproduce, systematically extract, republish or commercially exploit substantial parts of RenterCheck without our permission, except where applicable law or the licence governing the underlying information permits you to do so independently.

16.Our responsibility to you

We are responsible for losses that are a foreseeable consequence of our breach of these terms or our failure to use reasonable care and skill where the law requires us to be responsible.

We are not responsible for losses that are not foreseeable or that result from circumstances outside our reasonable control.

RenterCheck provides information to assist your decision-making. You remain responsible for deciding whether to enter into a tenancy, make a payment or take any other action.

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Nothing in these terms excludes or restricts your statutory rights as a consumer.

17.Links to other websites

RenterCheck may link to government services, data providers, advice organisations and other third-party websites.

We are not responsible for the content, availability or privacy practices of websites operated by third parties.

18.Changes to RenterCheck

We may improve or change the website, tools, reports and datasets from time to time.

If we make material changes to these terms, we will publish the updated version on this page and update the date shown above.

19.Complaints and corrections

If you believe a RenterCheck report contains an error, has matched the wrong property, or you have another concern about the service, please contact hello@rentercheck.co.uk.

Please provide enough information for us to investigate the issue.

20.Governing law

These terms are governed by the law of England and Wales.

If you are a consumer, you will retain any mandatory rights you have under the law applicable to you.

The courts of England and Wales will generally have jurisdiction, subject to any rights consumers may have to bring proceedings elsewhere under applicable law.
